About these terms

Pinnacle Science Labs is a trade name of Pinnacle Scientific Limited Liability Company, a Wyoming limited liability company ("Pinnacle", "we", "us" or "our"). These terms govern your use of pinnaclesciencelabs.com and our secure payment page at checkout.pinnaclesciencelabs.com (together, the "Site"), your account, and any purchase you make from us.

By using the Site or placing an order, you agree to these terms, our Privacy Policy, our Research Use Policy, our Shipping Policy and our Returns Policy. At checkout you confirm this by ticking a box that is never ticked for you, and we record which version of these terms you agreed to and when. If you don't agree, please don't use the Site.

These terms limit our liability and set out how disputes are handled. Please read those sections carefully.

Who may buy

You may buy from us only if you are at least 21 years old and you are a qualified researcher, or you are buying on behalf of a research laboratory, institution or business. You need an account to order, and your order must be delivered to an address in the continental United States.

Before you enter the Site, and again when you place each order, we ask you to confirm that you meet these conditions. We keep a record of that confirmation with your order. We may ask for information to verify your eligibility at any time, and we may refuse or cancel any order if we can't verify it.

Research use only

Every product we sell is supplied for laboratory research and analytical use only. Our products are not drugs, foods, dietary supplements, cosmetics or medical devices. They are not for use in people or animals, and they must not be used, sold or given to anyone for that purpose.

We don't give advice on how to use, prepare or apply any product. You are responsible for deciding whether a product suits your research, and for handling, storing and disposing of it safely and lawfully, under the rules of your institution. Our Research Use Policy forms part of these terms.

If we reasonably believe a product will be used outside these limits, we may cancel the order, close the account and refuse future orders.

What you may not do

When you use the Site or our products, you agree not to:

• buy, use, sell or supply any product for use in people or animals, or supply it to anyone you know or suspect will use it that way;
• give us false information about yourself, your age, your institution or your research, or let anyone who doesn't qualify order through your account;
• describe our products as having any effect in people or animals when you sell, share or promote them;
• get around the researcher confirmation, ordering limits or any other control on the Site;
• open more than one account to get around these terms or to earn extra reward points;
• copy the Site with bots or scrapers, interfere with how it works, test its security without our written permission, or use it for anything unlawful.

Product information

Product names, product codes, specifications and reference data on the Site are provided for identification. On the public Site, products are listed by product code (for example, PSL-3RT). If you are signed in to your account, you may also see full product names. Each batch is tested by an independent laboratory, and the certificate of analysis (COA) for your batch is the authoritative record of its identity and purity. Product images are representative and the packaging you receive may look different.

We don't make claims about what any product does, and no one is authorized to make such claims for us. We work to keep the Site accurate, but errors can happen. We may correct any error, including in a price or description, at any time.

Orders and acceptance

Your order is an offer to buy. An order confirmation email confirms that we received it; it isn't acceptance. We accept your order when we ship it. We may limit quantities, and we may refuse or cancel any order, for example because of a pricing or description error, product availability, a failed eligibility check or suspected misuse. If we cancel an order you have paid for, we refund you in full.

Prices and payment

Prices are in US dollars. Volume discounts and bundle savings are applied as shown at checkout and don't combine on the same item. Shipping is a flat $10 on orders under $150 and free at $150 and over, as our Shipping Policy explains. Any sales tax that applies is shown before you pay, and the total shown at checkout is the amount charged.

Payment is taken by a third-party payment processor on our secure payment page at checkout.pinnaclesciencelabs.com. We never see or store your full card number. Your card statement may show the payment processor's name or ours. A price change doesn't affect an order you have already placed, except to correct an error as described above.

Payment disputes

If something is wrong with a charge, please contact us first. Most problems are solved faster that way. If you dispute a charge with your bank or card issuer, we may give the payment processor the records of your order, including your researcher confirmation, your agreement to these terms and the delivery tracking. While a dispute is open, we may pause the account and its reward points, and we may close an account that disputes valid charges.

Shipping, title and risk

We ship within the continental United States only: the lower 48 states and Washington, DC. Orders are packed and shipped by our fulfillment partner. Delivery details are in our Shipping Policy. Ownership of the products, and the risk of loss, pass to you when your order is handed to the carrier. If an order is lost or damaged in transit, our Returns Policy explains how we help.

Returns and refunds

Returns and refunds are covered by our Returns Policy.

Email and text messages

We send order, shipping and account emails, such as password resets, to the email address on your account. Marketing emails and marketing text messages are sent only if you opt in, and you can stop them at any time. You agree that we may give you notices and keep records electronically.

Text messages. If you opt in to texts from Pinnacle Science Labs, you'll receive recurring automated marketing messages about new products, restocks and offers at the mobile number you provided. Consent is not a condition of purchase. Message frequency varies. Msg & data rates may apply. Reply STOP to cancel or HELP for help. Carriers are not liable for delayed or undelivered messages. Our Privacy Policy explains how we handle your number.

Accounts

You need an account to place an order. You can create one at checkout. Give us accurate details and keep them up to date. An account is for one person, or one person acting for one organization. Keep your password private: you are responsible for everything done through your account, and you should tell us straight away if you think someone else has used it.

You can ask us to close your account at any time. We may suspend or close an account that breaks these terms. When an account is closed, we keep the records our Privacy Policy describes. Staff and administrator accounts can't be used to sign in on the Site.

Reward points

Account holders earn 1 point for each whole dollar spent on products, once the order is delivered. Points aren't earned on shipping, tax or points spent. 100 points take $10 off a later order. If an order is canceled, refunded or returned, the points it earned are removed and any points spent on it are returned.

Points have no cash value, can't be sold or transferred, and are not earned or used by wholesale accounts. If we close an account because it broke these terms, its unused points are canceled. We may change or end the rewards program with notice on the Site; points already earned stay usable for at least 90 days after that notice.

Wholesale accounts

Wholesale accounts are open only to research laboratories, institutions and businesses that supply research materials to them. We don't open accounts for clinics, medical or wellness practices, med spas, pharmacies, compounding facilities, telehealth services or practitioners. We review every application and may decline one without giving a reason.

Wholesale pricing is set per account, isn't published, and doesn't combine with other discounts. These terms apply to wholesale orders unless we agree otherwise in writing. We may ask for evidence of eligibility at any time and close any account we find supplying material for use in people or animals.

Limited warranty

We warrant that each product matches the identity and purity stated on the COA for its batch at the time of testing. If it doesn't, we will replace the product or refund what you paid for it, as our Returns Policy explains. That is your only remedy under this warranty.

Apart from that warranty, and to the fullest extent the law allows, the Site and our products are provided "as is", without any other warranty, express or implied, including any warranty of merchantability or fitness for a particular purpose.

Handling risk

Research materials can be hazardous if they are handled, stored or disposed of incorrectly. You accept those risks, and you are responsible for making sure that anyone who handles our products is trained to do so and has suitable facilities and equipment.

Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or research time, arising from the Site or our products. Our total liability for any claim is limited to the amount you paid for the product that gave rise to it. Some states don't allow some of these limits, so they may not all apply to you.

Your responsibility

You agree to defend, indemnify and hold harmless Pinnacle and its members, employees, suppliers and fulfillment partner from any claim, loss or expense, including reasonable attorneys' fees, arising from your misuse of a product, your breach of these terms, or your violation of any law.

Compliance with laws

You are responsible for making sure that buying, possessing and using our products is lawful where you are and under your institution's rules. We don't ship outside the continental United States. If we suspect a product is being misused, we may share relevant records with the authorities, and we will cooperate with any lawful request.

Using the Site and other services

We may change, suspend or withdraw any part of the Site, and we may close ordering for a time, without notice. The Site links to services run by others, such as our profiles on social media platforms and the payment processor. Their own terms and privacy policies apply when you use them, and we aren't responsible for them.

Intellectual property

The Site and its content, including text, images, logos and design, belong to us or our licensors. You may not copy or reuse them without our written permission.

Governing law and disputes

These terms are governed by the laws of the State of Wyoming, without regard to its conflict of law rules. If you have a complaint, please contact us first and give us 30 days to try to resolve it. If we can't, any dispute will be brought in the state or federal courts located in Wyoming, and you agree to their jurisdiction.

Any claim must be brought within one year after it arises, unless the law requires a longer period. Nothing in these terms takes away any right you have under the consumer protection laws of your state that can't be waived by agreement.

Events beyond our control

We aren't responsible for delays or failures caused by events beyond our reasonable control, such as severe weather, carrier or supplier disruption, outages of the services we rely on, or changes in law.

General

These terms and the policies they refer to are the whole agreement between you and us about the Site and your purchases. If any part of them can't be enforced, the rest still applies. If we don't enforce a right straight away, we haven't given it up. You may not transfer your rights under these terms; we may transfer ours to a successor business.

Changes to these terms

We may update these terms. The date at the top shows when they last changed. The terms in force when you place an order apply to that order, and the version you agreed to is recorded with it.
